LILA and Incapacity benefit

Hi there

I have been advised by the CCCS that bankruptcy is my best option as i have a debt of £13,000 and have no means of paying it back now. I live in Scotland and just want to check if anyone knows about incapacity benefit and LILA.

I meet all the other criteria for LILA, but it doesn't mention if Incapacity benefit is an eligible benefit or not. I receive only Incapacity Benefit, live with my parents and i am not in receipt of any other benefits, aside from HRM DLA, which is paid direct to motability for a car.

I have looked an on the AIB website but it doesn't mention Incapacity Benefit on there and the AIB phoneline just rings out.

    You can make an appointment at Citizens Advice with a Money Advisor, take proof of your benefits and bank statements showing that you have no other income, they will issue you with a Certificate of Sequestration to show that you appear insolvent. You have 30 days to use this with the form sent to the AIB. The AIB need to know you are insolvent to qualify for the LILA scheme - they won't ever take payments from a benefit you receive, such as Incapacity.

    Incapacity benefit will still leave you eligible for LILA, as long as you have no single asset of over £1,000 or all assets totalling over £10,000.

    Motabilitiy cars will also be left alone
