    He should be paid for holiday accrued but not yet taken. Does the holiday year run from April to March or January to December or some other 12-month period?

    I thought that if the person really has the intention to go for an employment tribunal, it was worth NOT reminding the employer of the statutory process. If the employer then does not allow them to be accompanied, doesn't that automatically make the dismissal unfair? Or is that something else I'm thinking of?

    I think its that I phased it wrong, like I said all overtime was worked - the point I was trying to make was that my OH was so committed that he willing spent his own money because his employer wanted him to work on this contract several hundred miles away from his home.

    I think the evidence is that her OH has been sacked while other colleagues who also worked on this contract (in the same team and in subsequent work) have not been fired.

    Agreed - it is better not to prompt them!
  • One of my pet hates is letters starting with "I'm writing to tell you ..." or variations of. It's completely unnecessary IMO.

    It's also best to ask specific questions in a letter/grievance.
