BR and tax rebate

i am due a tax rebate but went br last week can we use the money to replace our car as its falling apart i am not talkin thousands just maybe £1000 what would happen with the paperwork as its the old car listed the OR has not looked into us yet

    Tax refunds/rebates from the tax year you went BR in and all previous years belong to the OR.

    HMRC will either pay it direct to the OR, or you will be required to forward the funds to them.

  • even if we did it now we have still had no contact from the OR. can some of it be given or negotiated as our car is fallin to bits????

    You need to talk to the examiner dealing with your case and put your arguement to them. You also can't do anything with the current car until you have spoken to them (as at the moment it is an asset in your BR)

    It's unfortunate but the chances are that if you haven't already signed it, you'll have a form to complete (TNIDIS Tax & National Insurance Disclaimer) which means that any rebate will belong to the OR. AFAIK, it doesn't matter if you don't complete your tax return until the last minute and it falls outside of your BR (i.e. you get early discharge), you'll still not see any of that money.

    It's a pain in the bum, isn't it? Despite me telling HMRC that they'd got my tax code wrong for the last 12 months, they still insisted on taking the money. I'm likely to be owed £500 when I do my tax return but I know the OR will grab it before I see a penny. Ho hum. The joys of being BR, eh?

    BaldEagle - surely if you've kept copies of letters sent about this you would have a good case to put to the OR?
