Welcome Finance / Mackenzie Hall HP Nightmare

Firstly thanks everyone for using this forum, i have been a bit of a 'lurker' for a long time and have always found it an excellent resource, However i have found a myself in a situation and desperate for some advice.....
Bear with me as its a length story i'll try make it as easy to read as poss....:o
Back in November 2006 i applied for car finance through a broker called 'Netcars' they asked what type of car i would like etc and said they had one local to me that they could finance for me. Great i thought so i awaited their paperwork through the post.
A few weeks later i had a letter from welcome finance explaining they were financing the car on behalf of Netcars as they were only a broker. and they required me to do the usual sending back and forth of my personal information it was all going smoothly. To be honest i was quite surprised i could get finance at all as i had a few defaults from credit cards when i was younger etc.
Anyway the day came for me to collect the car i had already seen photos of it and been provided with a 128 point inspection report of its condition so i was forwarded an address of a car dealer to go and pick the car up. I collected the car any drove home over the moon that i had one and that i finally had safe and suitable transport for me and my little daughter. :j
But... yes there is a but... on the way home the oil light kept on coming on and going off. i stopped at a services on the motorway and put a little oil in and finally got back got back from the garage that is 20 mile drive. My dad came out to see the car and instantly said ' have you not seen the tyres?' .
'No' i replied... we both looked and all four tyres had wire showing on the inside edges and were in a poor state... then he said ' and you drove it back with no tax?'
You guessed it... i looked and there was no tax disc in the car, so much for the 128 point inspection and the 12 months road tax i had been promised.
so i called the car dealer who instantly became aggressive and said ' nothing to do with us mate speak to your finance company'
I called welcome and they refused to do anything after weeks of calling i was just fobbed off and nobody would speak to me. Eventually i had a reply saying they would replace x2 tyres but not supply road tax like they had promised in the first instance....
I proceeded to tell them how unhappy i was with the service and the vehicle.
Anyway we verbally agreed that they would replace the tyres and the tax then i would continue payments on the account. The only payment i had made up until now was the initial first payment.
They replaced x2 tyres and when i asked for the tax they changed the goalposts again and refused saying they now wanted the payment that was due. And told how lucky i was that they had replaced 2 of the 4 faulty tyres.
By this point i was at my witts end and i told them i as returning the car and canceling the agreement because the goods supplied were faulty. I drove to their local branch parked in the car park and gave the keys to the women there i had spoken to as to witch she replied 'fine' :mad:
This was Jan 2007... i haven't herd anything else since then as far as i was aware the awful ordeal was over thank god.... how wrong was i ?
I checked my credit report last week.. welcome finance have defaulted me in Aug 2009 ? for 10,000
But they took the car back and as far as i was aware that was the end of it..
Also why is the date of default 2009 ? i defaulted on payment on the first payment as thats when they had the car back Jan 2007 :mad:
When i saw this on my file i was filled with rage at the cheek of Welcome how do they treat people like this. Its not due to come off my file till 2015 when really it should be hitting the 6 years this year if they had updated their records correctly or have they been making payments on my behalf to extend my default ?
Anyway sods law has come into play now... constant text messages from a company called Mackenzie Hall asking me to call them... i have ignored them but they were sending 2-3 a day.. so i filed a complaint through their website only to be told that they are contacting me about ...... you guessed it 'Welcome Finance' and are trying to collect the money for a car i never had !
Help !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
I don't know what to do its affecting my sleep driving me mad in the day at work. :mad::mad::mad::mad:
Do i go bankrupt ?
Is their a way i can get this debt written off as we mutually cancelled my agreement and welcome took the car back ?
their so no way i can afford to pay a 10k debt for something i didnt have and i don't feel i should have to either.

I am not a lawyer and I believe you need one; at least go to your local Citizens Advice Bureau and have speaks with their duty lawyer.
At whose branch did you leave that clapped-out jalopy? Was it at the lender's offices, or at the "car" dealers? Did you get a receipt for it, or any confirmation that you had repudiated the contract to buy that load of rubbish and had rejected the "car"? Can you even recall the registration number? If you can, you may be able to find out from the DVLA what became of it.
It seems to me, as a layman, that one way to proceed would be to require the company where you left that future heap of junk to "render up the goods left in their bailment" - to wit, the car - or the £10,000 being the value thereof. If the car was scrapped or sold to someone else, they'd not be able to let you have it.
It may also be worth speaking with your local trading standards department at the town hall. Do not bother with Consumer Direct or try phoning trading standards as you'll only be transferred to Consumer Direct, whom I believe to be less use than a tea pot made of butter. The OFT is equally useless, which is why I call it the Office of Faffing and Twaddling.0 -

Jesus! This is one of the most flagrantly shocking threads I've read on MSE. I don't think I've ever seen a 'defective goods' story as bad as this one.
This is between the dealership and Welcome. You've handed the car back as defective, which it was - if you've retained proof the car was handed back, that should be the end of it.
Welcome can't hold you liable for an unsatisfactory item you handed back to a dishonest dealership.
As for MH, forget about them. They're irrelevant in any case.
Haven't Welcome Finance gone under? I thought they had, but if they haven't, they thoroughly deserve to.0
