    Well, if you did actually default there's nothing you can do, other than let it drop off in October. If you stopped paying 6 months prior to the default being applied then it'll be going SB around now.
  • Hi all, and thanks for the previous advise, I sent letters to the DCA's stating that I did not acknowledge the debts they are trying to recover and that they would be statued barred, they have obviously completley ignored those letters and continued to phone several times a week and send more letters saying I must pay immeadiately. HFOS have sent a letter yesterday saying I have 72 hours to make a payment or it will passed to their "solicitors" to start litigatation proceedings.. I am now unsure as to where to go from here? I will send out letters again but they dont seem to take any notice of these. Are there specialist solicitors that can deal with these companies I dont mind paying out for a solicitor if they can get these low lifes off my back.

    If they ignore your letters regarding telephone harassment, then you report them to the FOS, OFT and trading standards.

    Not to put too fine a point on this, but are these debts yours? And they are not statute barred yet, correct? So at this point you are still responsible for them.

    I will be the first to admit that I'm baffled that you are willing to put good money into paying a solicitor to avoid paying your debts. You're saying you don't have thousands to pay them, and don't want to pay them as they bought the debt for pennies. But yet you're happy to pay a solicitor? I have no fondness for debt collection agencies either, but this seems a bit awkward.

    Keep a record of any 'harassment' but some of you need to understand that legally speaking you cannot claim harassment if you are ignoring their calls because they will just claim that they never actually made contact with you (which is true). Only after you have notified them that the debt is not yours can you start claiming harassment. By the way when they are chasing the correct debtor they have a bit more leeway in terms of making what one might call excessive contact.

    If you have provided a valid reason as to why they are incorrectly chasing you for a debt and they are still chasing you then log everything and report it.

    By the soudns of it they are chasing you for a legitimate debt. Perhaps contact the original creditors and find out what the deal is?

    If you are adament on not paying then let them take you to court should they so wish.
