    If they are binding you to a contract then they should pay you, IMO the contract is not worth the paper it is written on.

    Seems IHC and Peter1³ are at slight crossed purposes. IHC's beef (I believe) is that the employee should be free to work where he/she wants (but of course minus the client portfolio). IHC's statement is on the grounds that it could be deemed unreasonable for a company to expect someone to sit at home for 6 months after resigning and not take employment unless he/she is paid a retainer or garden leave. Pete111 seems to be focusing on the poaching of clients which I think everyone is in agreement, is enforceable through contract.

    Different issues, albeit covered in the same clause of the OP's contract. One would definitely need to be challenged the other is quite acceptable/commonplace.

    I have had a letter from them telling me I should stop all contact with anyone who has anything to do with their business, I have built up many good relationships with some of the clients and agency staff who are now personal friends rather than work friends. Surely they cannot tell me who I can and cant be friends with?

    I suspect this goes far further than the law would see as reasonable. However you do need to get qualified advice on this from a specialist who has the full facts.

    Most likely the company know this and it is a try on. The problem is how far will they push the matter. It could easily turn into an expensive game of who blinks first.

    I refuse to end friendships that I have fomred because the company is so worried who might find out their secrets, I have much more important things to talk about than them so its laughable to think that I would be affecting them through having personal relationships with people.

    Couldn't agree more - this will be utterly unenforcable nor deemed reasonable in law
