debt collector invasion.

I have a debt with capital one £1004.02.
After a dramatic change in my circumstances the c.a.b advised me and set help up a low repayment plan.
This was a standing order of £2 per week.
Payments stopped in 2008,i cant remember why,foolishly.
Ive tried to call (around the time) capital one to reset payments but they said i missed two months payments and have passed my debt on....so far ive 5 agencies after the same debt that all hounded me at the same time,who do i pay?
I have my bank statements from 2008 for my own sanity and proof of payments id like to pay cap one directly again...this default is unwanted on my credit file and i want rid!
My credit rating is "poor" due to this alone.
Strange as capital one send me (in my full name) credit card applications.!
I want to pay but speaking to mackenzie hall staff etc etc are degrading.
My best step is??
And if repayments commence will the default be cleared from my credit rating??

    Who sent you the most recent debt collection letter? MacHall?
    Write back to them with a prove it letter. If they can prove you owe the money and have proof of the debt then pay them.

    You cannot pay capital one anymore if they have passed the debt on.
    You will not get the default removed, it will remain on your file for 6years from the date it was entered. Even if you pay in full before then it will be marked as a satisfied default but still show.

    Your best step is not to call any debt collector ever, only deal with them in writing.
    Could you afford a lump sum to the debt? if you could then you might be able to get them to settle the debt for less for a full & final settlement. If not then how much can you afford to repay to the debt a month?

    I was refering to my mailbox being invaded by several different debt collection agencies.

    Sound advice above - but I would add to send that correspondence by recorded delivery, and - this is absolutely essential! - do NOT sign any letter you send to them or provide them with a signature at any point.

    DCAs are believed to have, in the past, scanned the signature on a letter and added it to a scan of a credit agreement, then printed out the montage as if it was a genuinely signed agreement. I am not a lawyer, but I believe that most people would call that forgery.

    This apparently came to light when a CAB advisor. acting on behalf of a client, signed a letter requesting a Consumer Credit Agreement and sent off the request together with the statutory fee. The DCA seemed to comply with the request but, on closer examination, the "signed" agreement bore the client's name but the advisor's signature!

    Never thought they'd be as underhand as that, good to know what your dealing with really !

    When I was getting harassed by Lowell, I sent the letter by email, that was 1 year ago. They wrote back to say there were investigating and I never heard from them again.
