Didn't get holiday pay. Is this legal?

Hi,

Last year I was told I was unable to take any of my holiday time off as we were too busy at work. I expected that I would still receive my holiday pay on top of the hours that I worked, but was told I wouldn't be able to receive this. Can anyone advise on whether or not this is legal, as I thought holiday entitlement was the law!

    Have you got evidence to show that your employer refused you time off for holiday, that you could not take your entitlement before the end of the holiday year because you were prevented from doing so by your employer.

    Not really, there was a notivce put up in the staff room to say 'no more holiday can be taken' so other staff saw it. I know that they did pay some staff that couldn't take their holiday, but not me!

    You are legally entitled to 5.6 weeks, which based on a 5 day working week is 28 days (can include BHs).
    Is it the statutory requirement which has been refused or occupational AL which is above the statutory requirement?

    You are required by law to take the statutory requirement and this cannot be exchanged for pay instead. As anamenottaken said, have you proof that you requested holiday and had it refused?

    Thanks for your reply! It is the statutory requirement. As I said above, I don't have any 'official' proof!

    Sorry, I hadn't seen your post until I'd posted. Does your employer have a HR department or a union rep you can speak to?
    If not, it may be worth contacting ACAS and asking them for advice.
