Just found this on a website, post from May 2007

Can anyone try and validate the info?

You might like to look carefully at the court papers and note the date. Check that it is definately Brian Carter and Co and not Crellins Carter, this is important.

Here comes the good bit.

On the 28th of Feb, Brian Carter and Co ceased trading.
Any communication on headed paper, any attempt at practcing law etc, in your case by issuing CCJ paperwork is illegal.

I am assuming that the court is Northampton and if so you may contact them and inform them of the above and that as such they are not allowed to present your case. Do not ignore the papers though as Northampton is having some difficulty accepting this information.

The Law Society states that Mr Carter can still pursue existing fee's which were accrued before the closing of his company but cannot act on anything after. Collecting debts on someone elses remit does not count so he cannot do anything to you and you are not bound to pay him for such debt either.

I would also photocopy the court claim papers making sure you have the date and Brian Carters name visible and then forward this together with a letter pointing out the above facts to this address.

You might also ask them for advice on what to do with your summons given the situation.
