Garden Leave?

My employer is forcing me to work my notice from home but has set me impossible work tasks to complete daily or I will not be paid. Can this happen I would be using my own equipment, internet and electricity? Sorry meant to say Garden Leave x

  • The time allocated for each task is unrealistic and the amount of work would take me over my contracted hours. I do not have an office space so health and safety is a concern. I am willing to work my notice in the work place but told I would be refused entry.

    Do you know why your refused entry? Has the whole office closed or something? It is unreasonable to ask you to use your own equipment (how do they know you have a laptop/internet?) unless you usually work from home. Something sounds wrong here. Can you speak to your boss and try to find out why you can't come into work? Have you asked them about Garden Leave? During garden leave although your not expected to attend work you need to remain available for work during your notice, this doesn't usually mean working from home (unless you are usually a home worker). I hope you get to the bottom of it.

    If you're on gardening leave your employer should not be giving you work to do. That's the whole point of gardening leave.

  • The work place is a children's day care centre and don't think my employer wants me to see parents. I do not normally work from home and the laptop is my sons so limited use. Thanks for your responses.

    Just tell him then that you no longer have access to a computer or internet at home.

  • just found out my home needs to be risk assessed for health and safety reasons and equipment should be provided by my employer e.g it equipment, desk and chair. Does anyone know if this info is correct?

    We need some clarification here.

    Have you actually been put on formal Gardening Leave?
    Or have you been dismissed and been told to work your notice at home?

    Whats the contract of employment, about working from home.

    Have you been terminated what is in the termination notice.

    If there is no contract clause to, work from home, garden leave, employer not to provide work, then you most likely you will have a fairly easy claim to get paid

  • I have been put on garden leave not dismissed and working from home. I informed my employer they are obliged to provide me with the right equipment but still not had a response. Shall I continue to not do the work and stand my ground or cave in. Took further adivice from employment law, through different things that have happened in the past, been advised to resign with immediate effect stating conduct and treatment and going for constructive dismissal causing stress and anxiety, if I do this will I still recieve my holiday pay and this week pay? Any idea or advice kindly recieved.

    You are not on gardening leave. Gardening leave is leave ilike annual leave and sick leave - the employee does no work for the employer whilst on leave.
    Please clarify this with your employer before taking further steps.
