Fired from job in 2002 and got a ccj for training

Hi

i was a bus driver and had gotten fired in 2002 for a bad accident,(believe me I fought all the way to the top for an appeal) but unfortunatley they then slapped me the training money dispite them sacking me. If you leave before the year is out you have to pay it but i didnt leave!!!

I fought this with my solicitor and I heard nothing till 2007 but it was too late i was moving house. I arranged with my mum to send my mail on to me while i was moving to northern ireland and was trying to sort this out. UNFORTUNATLEY she isnt realiable and then took it upon herself to not send mail, (and on some occasions open it then send it...grrrrr) and I got the appointment for court too late. I fell out with my mum over this and her demanding four grand herself from house sale...:(

This ccj is still unpaid on principle that i didnt leave plus my mum not sending my mail on.I havent contacted the court as im scared they will demand money I havent got.

Its now affecting me getting a really well paid job in a bank. Its a bit of a vicious circle as I cant get the job i want due to a ccj from a job that gave me one...Im now unemployed.

correct me but i thought after six years of a ccj its no longer valid.Or s that if you pay it.?

any ideas of how I can wriggle free from an unfair ccj??

    If a debtor hasn't paid a CCJ and a period of 6years elapses then to enforce the CCJ (eg send bailiffs round etc) the creditor would have to go back to court to obtain their permission to continue to pursue the debt.

    After 6years your CCJ would no longer show on your credit file. If the CCJ was granted sometime in 2007 then it will be on your file until sometime in 2013.

    The only way to remove a CCJ would be to apply for it to be set aside and to be able to convince a judge that you never owed this money. But if a solicitor already looked at this for you and you were still given a CCJ then I would think the chances of the court agreeing you don't owe this money are diminished.

    having a blonde moment here so please excuse me. lol :)

    If the ccj isnt paid at all and the time expires by dec 2013. will it by then be removed at all no report of it against me. will i have this indelable mark following me around for life?

    (Tbh its affecting me getting employment and ideally id rather get it gone, but i cant afford it).oh and another thing if the debt wasnt a ccj till 2007 but was a bill from 2002 does this become an unfair ccj anyway?

    they took you too court within 6 years, so not much can be done about it. You need to check the employment contract

    Anyway once you have a CCJ you're fooked, even paying it will not revoke it (it gets a notice of correction rather than being removed so it still counts against you). On that note, once it's got that far I wouldn't bother making any attempt to pay it off unless you're being hounded by bailiffs (if they do knock on your door to recover a CCJ you are legally obliged to let them in, otherwise you could find yourself in even more trouble with the law - trust me I speak from experience!)

    This is not correct. If bailiffs collecting a CCJ call at your property you do not need to let them in and they cannot force entry to your property. If you leave a door unlocked or a window open that they can access then they can enter through that but if they are shut and locked then they won't be able to.

    And if you pay off a CCJ it will be marked so it shows as a satisfied CCJ rather than an outstanding one - not a notice of correction.

    1. Yes, you did leave your job. It just wasn't by choice.
    2. Your contract will no doubt state that if you leave (by resignation or by misconduct) in the first year, you will be liable for your training costs.
    3. It's not your Mother's responsibility to forward mail to you - the Royal Mail could have quite easily set up this service for you.

    You seem to be basing the whole "get out of CCJ" issue on the fact you didn't leave your job. I'm afraid a court would see otherwise.

    Stop, !!!!!!, blaming your mum, take responsibility for your self, you should have organised a redirection with the post office.

    It is not unknown for an insurance clerk and failed applicant for the job of bus conductor to move to working in a bank, subsequently becoming Chancellor of the Exchequer and then PM.

    Wrong!

    The Registry Trust Ltd retains records of HCJs and CCJs for a maximum of six years.

    Nor is one legally obliged to admit a bailiff acting on a Warrant of Execution arising from a CCJ or HCJ:
    If the bailiffs come to your home, you don't have to let them in. They can't force their way in, but they can enter through an open window or an unlocked door.

    Forced entry includes pushing past you once you have opened the door to them, or leaving their foot in the door to prevent you closing it. Such action would make the whole process illegal.

    Bailiffs recovering unpaid magistrates' court fines, however, do have the power to force entry, but this is always a last resort.

    Bailiffs trying to recover money you owe to HMRC are allowed to break into your home, providing they have a magistrates' warrant - but this method is rare and only used as a last resort.

    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared
