overdraft repayment

Hi, was wondering if any one would be able to give me some advice,
today i have received a letter from a 'Fredrickson International Limited' demading that a pay the full amount of an overdraft i had. but....

i have being paying regular monthly payments to the bank for over a year and they havent once questioned it ive received nothing from them saying that this wasnt fine! this is the first letter i have gotten since setting up repayments a year ago.

Should i have gotten this letter if the bank has never notified me saying they werent happy with my repayments, do i have something to complain about to bank if they have made me think that i have been paying it off and account closed and charges held so i could pay it back, because what they are demanding of me is the same amount a year ago!
Thanks :)

Just bumping to see if the morning crew have any ideas, personally I would go and speak to the bank to see why the debt has apprently been passed on.
Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)

    hi, thanks for replies,

after many phone calls to banks and fredrickson, they have put account on hold and are investigating it. I printed off all records of every payment i have made and got a copy of agreement.

today they said it had gone to debt collectors because no formal agreement had been made with the bank like not talking to a person and setting it up, but if they didnt like the way it was done which was through a link on their site surely after a year they should notified me and if you werent supposed to do it like this why let people.

Firstly Freds aren't a scam, they're a mainstream DCA (debt colelction agency), sadly. They are unscrupulous, but then you should always assume any DCA is.

It is just proceedure for a lender to send accounts in arrears to DCA's, they do it in bundles of thousands, it wasn't personal. The tosh you are getting on the phone is just that. Tosh.

It's annoying that Freds have gone in with the "we demand" approach but you should know that thier demands are no more weighted than mine or any other persons. I can demand that you lend me your car, if I did what would you say? I have exactly as much right to demand that as Freds do to demand full payment. The difference is that I will at least say "ok, fair enough" when you refuse, Freds will carry on like they have a God given right to the shirt off your back. Oh DCA's are a delight.

When you know what rights they have got you stop letting them get to you, adopt a yeah yeah approach and carry on as you were. Thier rights are precisely no more rights than you or I do, and significantly less than Culex does if you adjust for the specualtion that he rules his own planet in a galaxy far from here. :p

Being serious again. They "demand" yeah right. If you haven't got it that's all there is to it. Set up a standing order to pay them what you were paying the bank and write to them to say you did. Then ignore all the guff about "we don't accept" and "we require at least" and "we are considering taking you to court". Yeah yeah yeah... They wont. They wont because they can't legally send your money back to you, they can't get a result in court in thier favour if you are sending anything (even £1 a month) and they know this. They just hope you don't. They make on-commission salesmen look like models of honesty.
I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)

As of the last count I have cleared
    [STRIKE]23.16%[/STRIKE] 22.49% of my debt. :(
