Capquest

Hi, newbie here. I recently recieved a letter from capQuest issuing me with a statutory demand. I am in a small amount of debt with various companies and have been doing a little bit of research into my predicament, in the course of my research I found what looked like the demand form used by government departments. The capQuest letter looks almost exactly the same but with no form section to fill, where the form section is it just contains my name and address, the name of head of legal services and company address twice and other meaningless credit jargon, all double and triple spaced. I just want to double check if this is a scare tactic used by capQuest?

    Does it tell you what the debt is for?

    Have you checked your credit file?

    It is a fishing trip, they send out millions.

    IGNORE for time being. Until they write again and tell you what the debt is for.

    I herby issue with a statutory demand to pay me within 21 days the sum owed of £350.

    You owe me this money, but I am not going to tell you why.

    Would you pay it?
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    Yes, it is a scare tactic used by Crapquest (and others).

    They send "official" type letters, often with the term "legal department" somewhere in it, (i.e. the bloke at the next desk,) so that you will think that it is a lawful demand for money, endorsed by the courts. Of course, it is nothing of the kind.

    Don't be scared by this stuff, if they have taken over a debt which you know about, then just write them a letter offering a repayment schedule that you can afford. If you have no idea what the debt is and they haven't made it clear on their letter, ignore it for now. If you owe them money, it is up to them to prove that you do and they must provide information about the debt and the amount allegedly owed.

    If you get any further letters from them, let us know, we can tell you how to take it from there. On no account should you contact them first, especially by phone. If they do start calling and hassling you, again, let us know, we have a very good letter that will stop them!

    They had been calling but I kept sending letters saying that I didnt want to comunicate by phone, they didn't listen for the first 6 months or so but they dont seem to phone nearly as much as the used to

    You are forgiving; I wouldn't be.

    Perhaps you should send them another letter, requesting that they remove your telephone number(s) from your data files? When they call after that, they may be in trouble with the data protection wallahs who, if you can get them interested, may arrange for Crapquest to be soundly thrashed with a feather.

    We did, a few times yet they still kept calling. next time I get called I will be sending a letter

    If you have already asked for your number to be removed, the next step is to take your complaint to the Information Commissioner's Office.
