Hello new to this seqestration thing

Hi, i've been reading for the past few days after i found this during my enlightenment or should i say 'Lightbulb moment'! 
I inderstand things are different north of the border and when i rang the cab, he said we'll talk to the creditors first and then we can sort a re-payment plan out. I said 'I think it's possibly gone further than that', he said well we don't normally advise that route and its called sequestration and not bankruptcy'.
So there we are, I have tried to find a group helping with sequestration and so far this has been the most interesting, in the fact that I felt so alone and had no-one to talk to. The family, including the boyfriend have said countless times, how did it come to this?
Well it seems as though i'm goin through this alone, I've been off sick from work due to infection (possibly dam depression over this aswell) and therefore have not had my overtime for this month, so I couldn't afford to pay back everything as I have cut up the cards and stopped using my old friend plastic fantastic for the everyday things and money transfers.
Can i call the banks etc to see exactly how much I owe, this is due to a certain bank not sending me any info over the amount owed as it was passed over to collections ages ago (yes i should have done something then but split milk and all the thang!) and have received no other communication other than to say 'oh you haven't paid this month.... do so now!'
So, thanks for letting me ramble, I don't know if any of you are in scotland and can inform me of the procedure up this way.
and another thing, how am i meant to raise the money for the court when i cannot pay the creditors?!!:o
Thanks for letting me get this off my chest! I am so worried about the future one way or another and if this will affect my future jobs etc and family.......

ps not sure how to compile the soa as I still seem to have more going out even without the debts (this is without the overtime which i am bound to get in the run up to xmas) do i have to tally this so it looks better. LOL

Hi fuzzy - just a quick word of welcome (from a sassenach :rolleyes: ) There are a few threads about sequestration and I will post some interesting links, to other sites, which can give you specific advice, tomorrow - as I am cream crackered and off to my bed now.
In the meantime - why not have a look at the Bankruptcy Club and Supporters Club thread, and see how many of us have dealt with it.:beer:

Thank you for doing that. However I don't think payplan are my way forward I had a quick chat and I don't think they're for me.
I am now heading to the cab and see what they can advise.

Good luck with CAB - I'm not trying to plug PAYPLAN it's just that the site gives a really good overview of sequestration.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Hi, ok so i trotted down to the CAB :j
Most most unhelpful, i showed him a list i had been fretting over (as it seems even hypothetically with no debts to pay im still over my monthly incomings! shock horror!).
He suggests they write to them once he has jiggled my figures (oh the mind boggles, nah he wasn't all that lol!) and then we can set up a repayment plan to my creditors. i explained that would probably then last into my 70's! which obviously i would chose not to do (but i suppose if i have to have that delightful chain of creditors around my neck so be it).
I then asked about sequestration/bankruptcy, he said oh no it will be ages and a very long time before you think about that. I said no I would like to see what my options are and can i do it now or in the very near future as believe it or not 2 days late with a payment n the calls (from one lovely bank) have started already.
I then asked how much will that cost me, is it the same as in england where its under £500, he could not answer that or any other questions I had.
I do not wish to discuss consolidation as I know a few people who have went down that route and lost their homes, marriages and friends.
I'm back at square one, he said he will try and juggle my figures and get in touch and then i have to provide all the details of creditors. (this i could not provide as after many countless phonecalls to the money men, i could not get the address for snail mail contact that the CAB wish to provide! Jeez you would think they are making it hard for me..............intense sarcasm incase anyone was misled!)
I'm a loose threid as my old aunty bessie would say. I want to get this at least in motion and I don't want to just hide from my debt.
I was foolish and had a few sh*tty times and therefore I was reckless and got myself into the pile of cat mess i'm in now.
I just want to get a decent nights sleep, get rid of the virus I have been laid up with (not in my pc) and sort this mofo debacle out!

Just realised i couldnt spell sequestration never mind get help about it! doh!
How much is the norm (i mean within limits) for the soa, i find mine fluctuates. I have been eating mostly veggie stuff for ages and to try and find fresh veg is a dam nightmare in most of the supermarkets. Local veg shop closed down, can it get any worse!!! booooo!
Also my work have cut back on the o/t so that brings the incomings to even less. Would i be on BR if i took on a night job?
Also what is the things you can put in and the things you can't? The cab guy said pet expenses was not allowed along with birthdays/xmas or holidays. he also said my leisure allowance for swimming was not allowed although i told him the physio and the doc advised this. (tried to get referral but as i'm not on IB or JSA i cannot get this)

Hey Rog i don't know if you can read this or if i have to get this merged. No-one else is reading this and maybe i should have put a different thread title down but i feel so down and stuck and not sure where my head is at.
The cab was due to send me the stuff out and i've not received this yet. My boss (i've been off sick for other things but I'm sure this ain't helping at all) has referred me to occupational health. The OH advisor was mystified as to why i was being referred as I had been off twice in a year, nowhere near the trigger factor. Boss lady i'm so sure thinks i'm at it, docs line prove otherwise and I feel as though she has started picking on me and with this debt thing and getting no-where I'm at a total loss.

Hey fuzz - we're all here, but not all of the time - I'm just off to bed as I've had the flu, and I think a lot of us have suffered this week.
You should be able to collect the br documents from your local court.
Couple of sites to have a look at:
https://www.insolvencyhelpline.co.uk and you can also download information and forms from https://www.insolvency.gov.uk although you may have to follow internal links as these sites deal predominately with England and Wales.
Sorry I can't be of more help tonight - should be around tomorrow.
PS - Debt does contribute to stress, but it will start to get better once you know which direction to take.
