  • the business manager who he took did the orignal agreement doesnt work their anymore,they put my mate through to the next best thing and he knew nothing about it at all,he suggested my friend emails either barlcays head office,or ring experian and let them do the digging for him,this was the guys advice.
  • Experian inform people that they will take 28 days to start investigation with bank so they advise people to go direct to bank first
  • oh right,ill let my friend know this.it seems strange he has heard nothing ever about this debt and no one seems to know anything about it,could this not be a case for him getting it wiped from his credit file

    It sounds like its time your friend got the paperwork that relates to this debt and has a look. He should write and state that he acknowledges no debt and then ask for a signed copy of any credit agreement that the creditor holds.
    He needs to enclose a £1 fee. Send it recorded delivery.

    Remember that businesses have much less protection under the law than private customers.

    What form of company was it that they created - given the had business loans it presumably was at least semi official - was it a Ltd company? Partnership? Ltd Liab Partnership?

    If it was a partnership then the creditor is entitled to chase one or both parties for the full amount of the outstanding debt though any partnership agreement would allow the one that pays it to attempt to recover the stated proportion from the other partner(s).
