I have moved into a new place about 9 months ago now, and have just received a letter from 1st credit asking me to call and quote a reference number. I did obviously to find out what this was in reference to and was told that i owe £1500 for a citifinancial loan going back to 2003. I advised them that i was unaware of this debt and paid a whole bunch of things off during consolidation 6 years ago now.
They stated i also owed money to money shop that was passed over to them in 2007, again i told them i have no recollection of this debt. They insisted that i owe these 2 amounts, so i asked for their address details and that if i send them a paid for envelope could they post me the appropriate CCA's for these 2 accounts. The woman abruptly said don't worry we can do that, thanks and goodbye and hung up?
Obviously i don't want to sit on this and pretend it never happened, so wondered what's the next best course of action? I don't acknowledge the debt and believe it's up to them to prove i owe this in the form of a CCA etc? should i send a letter and what should i be careful saying/ not saying....

incidentally i can see no reference to any of these accounts on my creditexpert report so can see no trace of defaults or CCJ's etc...0

Presumably you (a) dispute that you owe this in the first place, and (b) as this was over 6 years ago believe it would be statute barred even if you did?
If so, then there is a letter to send here:

on the phone they claim that an agreement was made to made payments of £50 a month in 2004 but this was not adhered to, as far as i was aware this was part of a debt that was settled by a relative 5 years ago. As they claim they have spoke to me in 2004 regarding this, should i pursue the statute barred approach or CCA request?0

Statute barred. Send the SB letter off by recorded delivery and do NOT sign the letter.
If they - or any other DCA, for that matter - contacts you about this at any point after 1st Credit get the SB letter, refer complaints straight to the FOS, the OFT and Consumer Direct.
And then do that each and every time a DCA so much as contacts you.0 -
Ok i'll go with that, many thanks!0

As a safety net make sure you've added all addresses you've lived at in the last 6-8 years to your CreditExpert profile, otherwise it won't show your full history. (Login and go to My Details). Include any linked addresses on the report you recognise as well.0

Well i'm sending the letter tomorrow but interestingly i had a call from mackenzie hall to my mothers address on friday evening, they never said what it was for but the timing suggests maybe 1st credit have passed it to these guys? mackenzie hall havent made contact with me at my address by phone or letter yet, so will just sent this to 1st credit for now as suggested previously and await a response.0

Well i was away on holiday for 2 weeks and having returned i did indeed have a letter from First credit, however it doesn't actually refer to any of the correspondence in my letter to them via recorded delivery and is instead a ' look at the discounts we can offer you' type letter showing savings i can make if paid within certain time frames. Obviously again clutching at straws in the hope i will admit to the debt in some way. Shall i send a further letter via recorded again asking for the same as in the first?0
