    Well CC did say a the last payment was made in 2007 - but they wont or cant prove it.
    thats a great letter - I'll send that.

    There seems to be a habit of CapQuest and similar companies making up a recent payment. They obviously hope that you won't challenge this.

    Often when people do challenge, it turns out that they have "made a mistake". ;)

    In the end if it went to court then you would demand that CrapQuest provide proof of this payment to the court. Can't imagine it would come to that, as CrapQuest must know that they don't have any.

    If they keep hassling you after this then report them to the people mentioned in the letter.

    In the end, it's up to the debt collector to prove that the debt is not statute barred.

    yes I agree - three times I've asked them to prove this since last September. If they did take this to court then I would contest it. I contested one a few years ago (cant remember who it was now MetCol or someone), it got right down to the wire, I rejected a TOMLIN ORDER and they backed down and sent a letter stating it would not be pursued any longer.
