If you are still working and you employmer had a problem and change your work pension to a different on so you claimed it by small lump sum and money each month
NOW THE TAX MAN SAY MY HUSBAND OWES THEM £710.00 BUT THE PENSION PEOPLE DID NOT TAKE ANY TAX OUT WITH THE CODE THEY GOT FROM THE TAX CAN WE APEAL AGAINST THIS????:o

    I have read this about 12 times, and still fail to understand what you are trying to say. Something about changing a pension. But 'lump sums' have to do with when you take the pension. Have you recently retired?

    You can always 'appeal' about what the tax man does or says. But that usually doesn't change anything if they are right.

    I'm just guessing. But maybe your husband was given wrong code numbers by HMRC. As a result, he has paid £710 less tax than he owes. I suspect this is one of the most 'recent' batch of errors by HMRC. My understanding is that if they have picked this up in the same tax year that it is due (2010/12) then there is absolutely no chance they will let you off.

    Normally no. The UK tax system works under self assessment. It is your responsibility to make sure the tax you pay is correct. Major errors sometimes do result in amounts being reduced but you shouldnt rely on that. If its a recent (as in last 3 years) error. Such as a delay in getting the right tax code applied, then it would be unlikely that they write any off. If its longer term and their error then there is a chance.

    It appears that:

    1. The employer changed pension scheme so your husband took the pension benefits from the old scheme, getting a lump sum and regular pension payments.
    2. For some reason this wasn't taxed correctly and tax may have been under-paid.

    He should:

    3. Ask HMRC to adjust his tax code to collect the tax that is owed over the next twelve months.
    4. Ask HMRC to tell you the details of the tax calculation and what the pension and PAYE should be using for tax codes to prevent the problem from happening again. Then check that work is really taking off the right amount.

    HMRC are likely to accept the request to collect over twelve months instead of immediately.
  • I heard on "Money Box" that HMRC have just spotted the same errors (yet again) resulting in lots of underpayments like this. Unlike previous ones, they have spotted this 'new' occurrence within the same tax year. Because of this, they have stated total refusal to write any of this off. hey will, however, listen to paying it over a future period, but only if the person requests it.

    Wasn't that the incident with those starting to get the state pension, not work pensions?
