Hi guys I have as I have said been helping a friend with his debts , hjust a quick question he has a cj about 4 years old he paid it up until 5 months ago then couldn't afford the repayments so stopped . What do they do now he has heard nothing from them do they go back to cout to get it enforced? or get the court to send a bailiff? or have they sold the debt?? what happens.

Perhaps it would be better if he applied to the court himself for a redetermination? they may set the payments at a level he can afford. This might be preferable than waiting for the bailiffs or whatever.
I believe that paying the court comes above paying things like credit cards and any unsecured loans.
I woudl suggest contacting one of the debt charities and chatting thorugh things with them - try National Debtline, CCCS or your local CAB.
Also try the courts services website for info. regarding how to enforce a CCJ as that is what the creditors will be looking at so you have some idea what could happen and also re trying to get a variation or redtermination - not sure what the correct term is but I would have thought it would be reasonably easy to find - also the factsheets on the National Debtline wesbite will no doubt talk you through the process of getting the ccj amount varied.

we did speak to the cccs who said with his other debts was to give £1pm which he is doing or go bankrupt as he has said if the bailiffs come he has nothing left to take he is a sitting tenant has 1 cooker/fridge/ table chair , sitting room a telly which is from the dark ages, sofa and a rug , bedroom 1 bed and dressing table and bed said table, outside fork spade few pots pollytunnell and his old aged pension .0

-fair enough then. Is your friend eligible for a DRO -it's a mini form of bankruptcy? Just wondering which is easier - wondering what's going on regarding the debt and having possibly letters coming through the door/bailiffs etc or whether it might be best to go bankrupt and see the back of all the debts - it's a tough call though.
I would check the National Debtline's website or double check with CCCS but if there's nothing to take then I guess the bailiffs aren't much of a threat.
Only problem I can potentionally see is if the creditors decide to go after his pension/benefits in some way - check this out as I'm not sure where he would stand with regards to this.

I think after he listened to a few of these people cccs/cab etc if he went bankrupt it would stop the odd letter which is all he gets now but nothing else positive would happen , bailiff is not an issue apart from the cj and the cab have said if they come he has nothing and they cant touch his oap and it is doubtful they would go back to the courts to get the bailiff . I think the advice was if you got the cash to go bust do it if not £1pm and get on with your life.0
