Can I force him to sell the house?

Hi everyone
Im sorry if I have posted this in the wrong topic.
I just wondered if anyone would be able to help me, I'm sorry if this has already been asked.
My ex-boyfriend and I brought a house 4 years ago, it was a 100% mortgage. When we split in December he said that he wanted to keep the house and I was quite happy to sign it over to him. He can not afford the mortgage by himself but he planned to get a lodger. The agreement between us was that as he was gonna keep the house he would pay the mortgage by himself (I don't think he relised how expensive it is)
Fast forward to now and he is in arrears in the mortgage by 1 month and hasn't made any steps towards getting a lodger. I have been in contact with the mortgage company (NRAM) and they have told me that they are waiving the early repayment charge so I can now afford to sell the house. The house is likely to be worth a few grand over what we paid for it, just enough to cover lawyer and estate agent fees.

The problem is I know he wants to keep the house and is not gonna wanna sell. Can I force him to sell?

Sorry I know its been a little long but any advice would be very much appricated.

  • Yes you can, but unless he co-operates it can be a long and potentially expensive exercise to force it
