I have an ongoing dispute with ccs/lloyds tsb and i have cca'd ltsb and have just been sent this letter by them
thankyou for contacting us recently
I am in receipt of your request section 78 documentation. however I am returning your letter to you as the card number is not stated on your letter, therefore we can not find you on our database. thankyou
ok so now what i dont have the original card number, i have the dca number and an 8 digit account number surely they can get their files from either of those as the dca are working for ltsb ???
I also sent the copies of all letters between me and the dca agency stating the dca numbers and the ltsb account number

Hi Sarah76
First off all what sort of credit account is this debt for?
Is it a credit card, loan or overdraft?
If it is for an overdraft then if you are looking to go down the CCA route and unenforceability then this debt will not be covered by the act, so there is no point sending off a CCA request.
If it is for a credit card/loan then you should write to the DCA with a simple 'prove it' letter asking them to provide proof that the debt exists.
If they have proof the debt exists then this should include statements, account number etc.
You can then resubmit the CCA request, as this sounds like its simply a delay tactic to try to wriggle out of their obligations and frustrate you.
Remember to never sign your letters (use a fancy font and digital signature) and always send recorded delivery

thanks I have cca'd everyone involved reported them to fos,oft and trading standards etc sent them every letter avaliable the wording on this one just baffled me as I have sent them all numbers I have with regards to the account. the wording just looked like ltsb were telling me i didnt exist ?????0 -
Then its simple, you ask them to provide proof of the account and the associated account numbers to establish the debt is valid!! If they cannot provide this, or refuse to, then keep this correspondance as this would make them look totally unreasonable.
You didn't answer the question on the type of debt - was this for an overdraft? If so then CCA is irrelevant anyway.

Sorry lol its a CC taken out 16yrs ago, surely as I have sent them the DCA letters as well they are not that thick that they dont know of their own accounts :-S or maybe they are nothing surprises me these days0 -
Whoa hold up. 16 years ago? When did you last pay anything towards it?I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)
As of the last count I have cleared [STRIKE]23.16%[/STRIKE] 22.49% of my debt.

lol sorry hannah 16yrs ago was when i originally took it out 7-8yrs ago was when i cut it up and Dec2010 was when I put account into dispute cause they couldnt provide me with paperwork for it, as i was questioning amount owed

this debt is almost certainly statute barred, if you have not paid anything towards it in the last 6 years.

no sorry didnt make myself clear really i was paying amounts till dec 2010, but wanted statements as i queried amount owed and had never had any statements from the dca etc and this has all unravelled as a result of that0
