Statute Barred
I had a credit account back in 2002 that I personally have not paid anything to for over 6 years but I have just found out that my mother has been paying £10 per month to them after the collection agency bullied her into it. She has stated to them throughout that she is not the account holder. Would Statute Barred be applicable here as it is not me personally that has been paying on this account?
Thanks

Christ that complicates things i reckon, i dont know the answer but i think you should stop her paying...how many years has she been paying? It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -
oh dead not stat barred0

I would recommend she stop paying immediatly and then issue a small courts claim to get the money back as she isnt liable for your debt unless its a joint agreement0
-
she cant small claims, as she volutary offered money to a debt owed0

The account is not joint and it can be shown that the payments have not been coming from myself but from my mother. I will happily pay my mother back the money she has paid so I am not worried about that. I just need to know if this would be classed as Statute Barred as it is not me (the account holder) that has paid anything to them in the last 6 years.0

I would suggest seeking some free advice from national debtline for this, it certainly will complicate things but if you can prove it was money paid by her and not yourself I think there is a chance it would be SB. The creditor probably won't accept it easily and if they decided to take you to court because they felt it wasn't SB then you'd need to be confident that your argument would stand up (which is why I would get expert advice on this one).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

I agree you need to seek professional advice.
It is of little consequence which account makes the deposit payments so you may be on shaky ground, the debt is, in effect, being acknowledged each time a payment is made.0 -
You could just pay back the money you borrowed, bit outrageous but quite a few people do.0
