Bankruptcy and Arrow Global

Hi,

Here's the long and the short of it....... I had a debt of £3500 with virgin credit card this debt was pasted to arrow global in 2009 I received one letter stating that the debt had been transferred to Arrow Global. I immediately contacted Arrow Global "sept 2009" and set up a payment of £100 a month and a charging order was made against my property untill the debt was paid back in full (I have proof of these payments being made by DD on my bank statements). Fast forward to late Dec 2009, i receive a phone call at work on my mobile from the OFFICIAL RECEIVERS OFFICE asking me why I haven't attended my appointment with them...........?? I have know idea what they are on about and the very nice lady on the phone has to tell me that I was made bankrupt on the 13th November 2009 petitioned by Arrow Global for the debt of £3500. I had absolutely no knowledge of this what so ever I never received any correspondence with regard to the court date nothing. The official receiver checked my address details and they were completely wrong! (but I no that arrow global have the right details as they had sent me a letter back in sep when they bought the debt and i set up payment) Anyway my world came crashing down and once I'd been to see the official receiver and explained the situation also taking along proof of payments made (one payment was even taken by arrow global after they had made me bankrupt) and the agreement they told me there was nothing I could do. I tried CAB but they didn't really have any idea where I stood and I couldn't afford to pay for legal advise.


So here we are in March 2011 and I receive a letter from Arrow global telling me that they have passed my debt of £3500

"We advise that Arrow Global, LLC has assigned all of its respective rights, title and interest in respect of the above referenced account (including the rights to receive payment of the outstanding balance) to Arrow Global Guernsey Ltd.

Please note that all current arrangements in respect of such account shall remain in pace and you should direct any queries to: Westcot Credit Services, PO Box 137........."

I've spoken with Westcot and they were unaware of the bankruptcy and asked me how I would like to pay back the debt?!

After almost a year and half of this very strange and dodgy situation making my life hell it's all coming back around. Surely I must be able to fight this in some way as I feel I've been treated very unfairly and not had any chance to of made myself heard.

Any advice would be fantastic.

    Didn't want to read and run as your post is heading to the bottom of the page.

    I'm amazed you couldn't have got the BR annuled as an agreement was in place and payments being made, and that you were made BR for such a low sum, incredible.

    As the debt was included in your BR then all you need to do is forward the letter to your OR, chasing the debt now is actually illegal, and the OR will contact the new company to advise them.

    There is also a template letter you can send direct which should stop them short. Hopefully someone will be along shortly with the link, I think it's in the clean up sticky thread if you want to go have a look.
