Wrong contract signed and being hassled for payments

Options
Hi,

This is my first time using this site so I am hoping that I am in the right forum!

I would need some advice on a contract I signed with a private college.

I originally agreed to pay upfront for 3 years and signed the contract for this. I however changed my mind to pay over 3 consecutive years and no new contract was signed.

I paid for year 1 and year 2 and come year 3 fell pregnant and asked to defer the course. They agreed but then sent me an email confirming I could not defer payments!
There are no terms and conditions about not being able to defer payments but their argument is that because it is not stated it is not possible to defer payments??

Someone told me that because I contracted to pay the lot at once on 5th February 2008 but did not do that with the agreement of the college, they then accepted less than what was agreed and the contract failed at that point. This means that as to my third years fees, no contract exists and therefore cannot be enforced.

Would this be correct please?

Thank you!
