13.6 We may give information to credit reference agencies
about the personal debts you owe us if:
• you have fallen behind with your payments;
• the amount owed is not being disputed; and
• you have not made proposals we are satisfied with
for repaying your debt, following our formal demand
With alot of people on here disputing monies owed through the CCA 1974, then according to the banking code they cannot update your credit file.
So you dispute, they issue default which according to this they cannot do, as you are disputing it?
Any thoughts

depends if you are disputing that the money or the amount is actually owed or are just claiming that the debt is not legally enforceable in court?
if you are disputing that you owe the money or the amount then that should arguably apply
if you are simply questioning the enforceability in court then it wouldn't apply. that question has already been decided in the high court.0 -

Ok throw something else into the mix, if you are claiming charges back would you think that that puts the account in dispute?

Again you are correct they are fighting this tooth and nail and just fancy another go at them. Took me 2 years to get correct info on credit file. Fancy another crack at Lloyds TSB.I all have learnt is from others on many sites.
