Sorry if this is a little late. however the advice i jhave always been given on this site is tonever get into telephone conversation if someone is alleging debt against you.
firstly tell them "hold on a second whilst i get my recorder" wait a few seconds then remind them as they will you that they are now being recorded.. this generally reminds them not to try bully tactics/ scare tactics on you.. after they then say what they have to say your next line in response is just " i do not consent to this dialogue" if you would like to contact me regarding yopur request please write to me.AND ON THAT PUT THE DAMN PHONE DOWN.
i have bee battling with 3 companys over the past 3/4 months
WESCOT CREDIT SERVICES... on behalf of Npower.
also Fredrickson international ltd and they could not get anything on me so sold the debt to BANNER JONES SOLICITORS, on behalf of ORANGE we also have pending a parking ticket from morrisons, which euro car parks, are now trying to have us pay £60 for my missus not being within the parking bay lines. i have been building up much experience with this lot on my case and i watch out on this site every nigt just to makesure i'm current and up to date on the latest knowledge of debtors.
there are hundreds of templates on here relating to creditors, harassment phone calls,etc the list goes on.. i have found them extremely useful, and like i say still had nothing but letters through the door with big scary word of door collectors coming and paying me visits.
as long as you know your rights i can't say as you could go wrong.
got one through today from WESCOT CREDIT SERVICES, and they have not even acknowledged my previous 2 letters, nor administrative £1 cheque for proof of agreement or contract to npower. they are getting up my nose.:mad:
so away goes another recorded delivered letter this morning to them.. i must admit i'm not entirely sure what happens when they enter into default as my 2 debts have this month, and i think the approach to them now changes?

Your westcot debt is in relation to a utility debt - is that correct? If so then when you say you have sent £1 to them for a copy of an agreement this would not be relevant to a utility debt. A request for an agreement with a £1 fee relates only to debts that come under the consumer credit act (basically loans and credit cards).
If you want to see everything westcot hold on file for you then you could consider doing a subject access request under the DPA with a £10 fee. But for a utility contract there is often no signed contract for the account anyway.
I'm not sure exactly what question your post is asking - can you clarify? You say that your debt has entered into default this month - what paperwork have you had that means you think that?
Usually any creditor who has the right to file data at the credit reference agencies about you will enter a default before a debt is passed to a debt collector. With utility company accounts sometimes they may have sought your permission originally to file info at the CRAs, sometimes not. Euro Car Parks can go away.
PLEASE PLEASE just ignore the letters, do not send one back do not call do nothing it will eventually go away.

my question maybe now a litle confusing Tixy asi did not know that utility bills had to be paid in this respect.. basicall we moved address last year in may, we were supplied with n power, we believe we paid all utility bills at the previous address and when we moved we were already supplied electric and gas by edf i believe!
anyway we switched back to npower after a week or 2 as they were our prefered supplier. they never said anything about us owing them for elecric account, and the next thing we know wescot credit services sent us a typical collection of debt letter.
i answered the phone to them and i was caught off guard at the time this all being around december 2010.she stated that we owed npower and i said i have no paper work in front of me to say i have paid but i believe i have. she was very nasty to me on the phone and i then just said i'll check up on it and ill write to them. so after 2 letters asking of any records they have on me and proof that i have not paid they still haven't acknowledged my letters.
my belief in the default was that once they had not replied to your request within 14 working days then it enters a default which to me meant that they cannot put a ccj on you without taking you to court to prove otherwise.
maybe i'm just taking the information i read on here wrong.... apologies for any misunderstanding.
can you set the record straight for me on this please.
in regards to the parking ticket i have not done anything with it... i put it up onmy notice board along with the first threatening letter i frecieved last week. i have not rang them wrote to them or anything... no acknowledgment from us what so ever.. i was reading previous threads on this and there seems to be what people are calling a TROLL within there, i think it was smithy2121... cant be sure but me and the missus were a little taken back by a new form of legal action taken on these parking tickets that people including me tend to be ignoring.
are we still right by doing this even after watching the watchdog clip on you tube as the link points out on previous thread

If you haven't already I would send westcot a prove it letter sent recorded delivery (so you can prove they have received it) and see if they respond to that.

Sorry a confusion about what you meant in relation to defaults - you mean them being in default of your request rather than you being in default for the debt. This does relate to consumer credit debts not a utility bill so not sure its relevant here.
I would send the prove it letter and keep the proof they signed for it (once they have) and then I would ignore any future letters from them until they provide proof of the debt (such as bills, details of the period being billed etc).

thanks again tixy. yep i did mean that in relation to the default, it did default yesterday, and recieved the generic warning letter today, i have always sent these debtors the prove it letter first and by recorded delivery, as i mentioned i,ve had no acknowelgement of those letters so i'm not sure where this one is going. it's almost as if there infamous "system" just picks up as no response within x amount of days and then sends a formal letter... this one says final warning and follows by a mention of a lovely little doorstep visit.
oh how i love those!

cheers Tixy, i have that letter on my computer ready for any such occasion, by the way it's very amusing at the end of the letter where as the person mentions he is confused and wants ti cuddle all and has emergency hob nobs..
i remember copying many letters of templates from here a while back and have used them since.
guess its just suck it and see for now, but great advice all the same..
oh is there any news on these so called DBA's being disbanned or finished with ... i heard something last week i think about possibly the OFT getting rid of a load of bad practising DBA's... is there a list of these?

They are not fines; at the very most, they are the fee for a contract between the driver of a vehicle and a [STRIKE]blood-sucking parasite[/STRIKE] parking company who acts as the agent of the landowner. As they do not keep any records of who was driving the vehicle and as that may or may not be the registered keeper of the vehicle, such alleged contracts are rarely considered to be valid.
They do fulfil one useful function, however. They help to keep the Royal Mail in business and (most) postmen out of mischief.0
