Advice Please: Partners Debt

My partner had a few issues with her previous partner. she took out all credit in her name and then the relationship ended leaving her with a load of debt which she was unable to pay. This has since resulted in a couple of CCJ's and a number of debt collectors sending letters to our house. We are trying to sort this out for her.

My question is really about the laws around debt collectors. It is my house and everything is in my name, the only thing we have together is the car which I bought but we have it in my partners name.

What can the debt collectors do with everything in my name? and, would it be worth changing the car over to my name?

As I say, she is seeking help with the remaning debts but at the minute she is getting hassled.

    Debt collectors - harassment and threats. No legal rights. Don't phone or respond to phone calls - everything in writing. Home visits are unlikely. If threatened with one, send the letter refusing access.

    Regarding the car, the legal owner and registered keeper are not necessarily the same - you bought it so I'd say you're the owner and could do a statutory declaration to that effect if needed.

    The only time it might be needed is if a creditor tried to enforce a ccj using the court bailiff. They are normally OK as they are salaried by the court.

    Has your partner got the ccjs on to an instalment order?(N245) - no enforcement is possible while the instalments are kept to.
