Old job / new job notice and leave query

Hi there
I was wondering if anybody could help me out as im in a bit of a pickle. I will give you a little background info first.
I work in a small organisation of 10 people in the north. I was in a management role when a new operations manager came in a newly created post. He has proven to be a real bully to the point where i have spoken to Acas about vistimisation and bullying, and they feel i have a good case which needs addressing with my union. I am not given leave in summer or easter when other workers are, i am not given the same degree of flexi working where others are, and my job is a shadow of what i did a year ago, very dispempowered and havent had any formal on the job training. All in all, i have been pulling my hair out. Complaints fall on deaf ears above and i get reprisals for going above his head.
But good news though.
I have been offered a new job starting in late sept and as they know me in a previous capacity i dont need a reference.
I have been approved 3 weeks holiday in sept (cant have it on the school holidays even though i have 2 children and other staff have none!!!!) I cant tell my manager that i have a new job as he may use it as an excuse to get rid of me, or just make my life a real misery for my remaining 5 months.
My contracted notice perios is very clear, one month.
So heres the question.
Can i give my notice in on the week before i take leave, thereby working one week of hell, then having 3 weeks leave to use up the rest of the notice period?
Can my manager retract my annual leave if i give in my notice, even though i may have spent £1000 on a family holiday?
At the mo im just keeping my head down, though all the other staff can see how bad i am treated....dont even want to make any more formal complaints, at least, not before i give notice.

It doesnt look like you have a lot to lose by giving the one week notice...you are entitled to the holidays, although you will need to check you have not taken more than you accrue if you are leaving part way through the holiday year, which I assume you will be.0

To retract agreement for a holiday, your employer would need to give you as much notice as the length of the holiday. For a 3 week holiday they would therefore need to give you 3 weeks notice before it started - so they don't have enough time to do that. (There could be a very sneaky way of trying to get round this but I wouldn't worry.)
If you really don't need a reference and you will be leaving everything in good order before your holiday, then just make sure that you hand your notice in allowing a clear month (starting the day after you hand in your notice) up to the date of termination.0 -
Thanks. Are these legal prescedents or just accepted norms. Is there somewhere i can read up on it, or print off to familiarise myself with it.
Youre aboslutely right, i dont have alot to loose and will be leaving halfway through the year, so will half calendar year leave which i will have if i dont take any other time off.0 -
