Paragon secured loan

Hello,
I would be really grateful for some advise.

I took out a secured loan against my house in 2003 for £26,500, this was a joint loan, however after splitting up with my partner this was changed solely to my name and my partner was released from this in 2004, we both signed an agreement modifying a credit agreement form.
I ran into financial problems in 2005 and i couldn’t keep up repayments, my house was repossessed in July2005,
I have not heard anything else about this loan until a few months ago ,there is still a balance of £28,000 to pay, there was a CCJ taken out against me in July 2005 for the remaining balance, something i am trying to get set aside as i was unaware of this,
I cannot afford to pay this loan, and need help with what i am to do next? I was thinking of taking out an IVA or even bankruptcy, I would also like to have the credit agreement checked to see if it is enforceable. I have not acknowledged any debt with them.
I am in court tomorrow for the set aside hearing, they are also pursuing an attachment of earnings order.
HELP please

    Who repossessed the house? If the loan was secured against the house, surely this should/would have been sorted when the house was lost?

  • no unfortunatley not, it was a second mortage so there was a shortfall which is where the 28k comes from.

    Sounds like there is nothing you can do until after you've been to court tomorrow and see what judgement is made against you, do you have any legal representation? and I presume you are going to go?

    Might be better to post on here after you know exactly where you stand, as they have already got a CCJ against you anyway, not sure why/how you think you can get that set aside though?
