They also state that the debt was not statute barred - fair enough if it wasnt, but do they also have to prove this one way or another?

So, which particular letter did you send in the end?
We sent the "prove it" letter, and asked for copies of the original agreement. They cannot privide this, and are also saying that they find it difficult to understand why she has been paying it fo r3 years. The reason being was they threatened bankruptcy, and she did not know any better.
She had an account with the bank in question but never had any kind of overdraft or a loan that she can recall.0 -

Did you request the copy of the agreement under section 77/78 of the consumer credit act and send a £1 fee?
Or did you just dispute the debt, ask for copies of the paperwork, and say it would be statute barred without doing that?

Also, are they still making payments or have they stopped?

We sent the "please provide under 77/78 of the consumer credit act" and sent the fee.
Payments have not been cancelled as of yet.0
