Advice on sons job

Hey all :hello: not sure where to post this as its just a bit of advice im looking. My son is 16 and works P/T at a supermarket/filling station stocking shelves & working the till. He got a letter with his pay yesterday regarding till shortages & petrol drive offs(people filling up & driving off without paying) If his till is more that £3.50 short on any night he with have the difference deducted from his pay which is fair enough BUT now if a car fills up & drives off without paying all staff on that shift with have that money equally deducted from their wage. Now to me this cant be legal, how can it be the responsibility of 3 staff in a busy shop if someone drives in fills up & drives off. There are cameras on the forecourt surely management could review this to get the drive off details?. This is how it states it in the letter
TILL SHORTAGES AS A RESULT OF A DRIVE OFF WILL BE DEDUCTED EQUALLY FROM ALL PERSONNEL ON SHIFT WE FEEL THIS IS FAIR AS WE DO NOT CONSIDER THE OCCURRENCE TO BE THE SOLE REPONSIBILITY OF THE CASHIER WHOSE TILL IS BEING USED TO PROCESS THE DRIVE OFF AMOUNT THEREFORE RESULTING IN A TILL SHORTAGE. IT IS TO BE NOTED THAT WE HAVE RECEIVED A LETTER FROM THE POLICE STATING THAT SUCH OCCURRENCES ARE TO BE DEALT WITH BY OURSELVES AT OUR OWN EXPENSE(I.E THROUGH SOLICITORS) So if he is working in the store and someone fills up £60 & drives off he loses his nights pay (£3.30 ph). Before i go & lose the head with his boss i'd like to know if he can legally do this?

i dont even thinkhe shold have the till shortages taken off. i use to work in a shop and the till was sometimes short sor sometimes over, nobody went till dipping as far as i know and we never got are wages slashed as a result, anyway if the take money when the till is short will they give him monery if the till is up???.......i think not. they can't have it both ways0

What has the drive off got to do with person serving, assuming they are working responsibily ??
Letter from the police confirms it is up to company to pursue the driver.
Any petrol station should have procedure to pursue driver & get money back
-but it's the company's problem.
The company is just trying it on with the meak employees.

i beleive this is illegal, i would call a advice centre or lawyer( you can get a quick free advice usually over the phone) , and check it out .

Call ACAS on 08457 474747. I'm in no doubt that the 'paying for drive-offs' is illegal and if they deducted anything from his wage and/or dismissed him for challenging the decision, he'd have a no-lose case against them.

Petrol is damn expensive, if you were to be held liable for 1-2 drive-offs you would not have any pay left !!
Do they enforce this policy, or is it just trying to keep staff on their toes regarding drive-offs ??

The boss said IT IS happening and will come into force on Monday, last Tuesday night while he was working out back sorting the newspapers to go back there was a drive off of £55.
