Help needed regarding photographer using pics on website.

We didn't give permission for our pics to be used on the website and I've also noticed a shot of our rings has been added to someone elses wedding album on the site.

Is there anything we can do about this? Can we just get in touch and ask them to remove the pics?

I wouldn't mind but some of the shots are awful! And there are some of family members who would hit the roof if they knew their pic was on the net.

Can anyone please advise?

If you have a contract check the fine print first as it may be in the small print. Otherwise contact him and ask him if he can remove the pictures. You could suggest he can use them in his printed albums but not online?

As above it may well be that the photographer retains the copyright to the pictures so can do with them more or less what they wish.

Check the small print to see if it says they can be used for publicity purposes. Most photographers will use pictures in portfolios to demonstrate their work to prospective clients but publishing them on the web is different so make sure you check the agreement.

I expect the photographer will have specified in the contract that they retain the copyright and may try to use this as an excuse to leave them up.

If I was you I would get in touch and politely say that you are unhappy with some of the pictures that are up, particularly as they did not consult you first, and that you would like them to be taken down as soon as possible.

I wouldn't worry too much about the picture of the rings. Although I would be annoyed too if I was in you situation.

    ***EDIT***

Some one beat me to it!

There was no small print in the contract and nothing in what contract I have about using the pics afterwards.

It doesn't even say that they retain the copyright, although I know the do because they took them.

I'll speak to my husband later and email the photographer later, thanks :)

Most contracts will give the photographer some right to use the images for the web. However, if he's used your image for someone elses portfolio, that's a bit naughty and I'd defo bring that to his attention.

    It's a she :D

Contract doesn't say anything like that at all.

Infact all it says on it is that deposit to be made, when to pay balance, to not let guests obsctruct photographer, if photographer can't make it for any reason they will use another, if pics get lost or destroyed then they will repay me any money I have paid them etc...

Not a contract full of small print at all and definitely nothing in it mentioning using the pics for their site.

I only noticed the rings pic because they were placed on a cushion in the reg office (bloody horrid cushion too lol but I wasn't there then so couldn't do anything about it) and I thought 'ooh that couple got married there too' so had a nosey at their pics, then realised they were our rings so opened my album up on the PC and it's deffo the same pic.

Are the T&C's on their website? With our photographer we had a contract to sign but part of it was that we had read the full and detailed T&C's which were listed on the website. I think they do retain copyright and just give you printing rights. However our photographer told us as part of the first meetings that he does use the pics for promotion in books and on the website and to enter competitions.

Our photographer has the rights to put photos on his site, and he usually puts pretty much all up judging by the site. But I know of one couple who will guests at mine who won't want their pics there (hassle from his ex-wife and her ex-husband!). My photographer has told me to let him know of any that I have concerns over and he won't put them public.
I think using them is one thing...but to put them in with another couple's wedding isn't on!

No, T&C's aren't on the site. I'm not bothered about them holding the copyright as I knew they would, but nothing was mentioned, not signed to say they would put them on their site.

See, if we'd been told beforehand like you were, we wouldn't have minded because we could have either not decided to go with them, or told them to not put pics of X, Y and Z up.

I was only clearing out my favs before and being nosey decided to have a look otherwise I'd never have known unless someone that knows us had come across it.

Give them a call and ask for the pic to be removed, I'm sure they will.
All my customers are told that their images may be used for online marketing and most ae happy with this. If not I always respect their privacy and their pics stay off line or in their own private password protected portfolio.
Don't be scared, its not in anyones interest to upset a customer, especially in a business that relies upon word of mouth recommendations.
