Please can someone advice me

my partner and i have recently split and he has moved out, i believe away from this area. for several months he has been on a debt management plan for several debts but since he has left he has not been making his payments.

i know this because i have been bombarded with phone calls and letters from various collection agencys making various threats.

what can i do to stop this. we are not married and have always had seperate finances but as this is his last known address they are not listening to me when i tell them the situation, maybe they think i am lying but they are now mentioning court action and bailiffs.

all his debts are unsecured and in his name alone but his name is on the tenancy agreement here and i am not in a posistion to move and as my landlord is abroad until september i cannot get him removed from the tenancy agreement until then.

can someone please tell me what i should do.

    I think I would write a letter to all the companies you can - point out he does not live here any longer. You do not know where he lives and that they should stop phoning you as it is harrassment and you will report them for it.
    Obviously if they continue to phone then report them to the OFT, Trading Standards etc. I'm not sure you can do much with the letters apart from write return to sender on them and hope they get the message along with your letter as Ibelieve they need to have an address and they need to write to the last known address.
    If he no longer lives with you then nobody can come and take your stuf. It's most likely to be a debt collector who should be sent away with a flea in their ear if neccessary and bailiffs should show id and you should tell them he doesn't live there anymore and send them away too.
    Have you removed him from the electoral role?
    You also need to tell the council tax people as well as this is the debt that could cause most problems with bailiffs etc.

    You shouldnt have to do anything, they are not your debts. Im also wondering how they have mentioned court action, bailiffs etc? have they spoken to you about his debts? they can get into serious trouble doing that.

    You could put a note of disassociation (sp?) on your credit file to state that he is nothing to do with you, I had to do this.

    Sure someone will be along in a mo with better suggestions.

    I don't know whether signing up with mail preference service would help? I believe you can make sure that any letters not for you are not delivered. I don't know what they do with them but it might distance you from it all?

  • does it matter that i cannot get him removed from the tenancy agreement for a few months?

    does anyone have a template letter i can send to these dca to stop them phoning and harassing me.

    I think the tenancy agreement is neither here nor there because it's a private agreement between you and the landlord.

    Worth writing to him to say your boyfriend has moved out to keep things straight, but the creditors can have no access to your landlord's records.

    The electoral roll is a good tip because that is a public document.

    Councils only update them once or twice a year, but you can certainly fill in a form to say only you live at the address.

    Write "Not known, please return to sender" on any letters and put them back in the post box.

    I was getting a lot of junk mail for a previous occupant.

    Marking the letters "return to sender" worked in the end.

    if you have no shared accounts other than rent:

    1. You are not responsible for your ex's debts. You are responsible for rent and Council Tax, which are joint liabilities.
    2. Creditors are REQUIRED by law to send all communicatiosn to his last known postal address. that might include information about court proceedings. Some of those letters are required by law to include warning about the possibility of bailiffs and bankruptcy. That does not matter to you.
    3. However, you would be within your rights to demand they remove your phone numbers from his records and will be breaking the law if they do not remove the phone numbers as you request.
    4. Some creditors may be stupid enough to waste their time and money sending debt collectors, or after court action, bailiffs. Neither have any right to enter your home to pursue hios debts.
    5. Start by asking the Council to remove his name from the electoral roll, as this makes it easier for the creditors to see he has moved on.
