Requesting Copy of Agreement & Financial Statement

Hi Everyone,

I have requested three times now since Jan, in writing to Welcome Finance for a copy of my original signed agreement/contract as well as an up to date finanical statement to show how much has been paid and what is still outstanding etc.

I have not heard from them or received anything!!

I am about to write another letter, and I was wondering whether by law they had to provide the things I am asking for? If so, it would be really helpful to know what the law is for this so I could put this in my letter in the hope they finally act upon my request.

I know its going to the correct address etc so im pretty sure they are purposly ignoring it.

Apreciate anyones help and suggestions!

    Did you use a proper template quoting the relevant legislation and enclosing a £1 fee?
    Are you sending it recorded deliv so you can prove they have received it?

    No I didnt use a template, do you know where I can get this from please? Nor did I know about the £1 fee :) I will include this and I was going to also send this letter recorded delivery this time to be on the safe side.

    I see this one doesn't specifically mention providing a statement of account but I would just add that in as an extra line.

    But they don't have to provide you with an actual copy of the original agreement - a re constituted one is probably the best you can hope for.
  • Ive just had a call from Welcome Finance, they will send me a copy of my agreement & finanical statement but the £1 fee is not suffice, they want to charge me £10 for this.
    I guess its another way of putting me off! However, I will pay them the £10 as I beleive they have been witholding information from me regarding my agreement! Hence why I want a copy of it!

    A £10 fee is for a full subject access request - if you pay them this then you want everything that you should receive under SAR under the data protection act.     When I call back to make the payment I should mention to him that the £10 should be for a full subject access request under SAR? Should I stand my ground on this too? He said that £10 is what they have been told to charge for a copy of my agreement!!

    The fee for a copy of your credit agreement (under the CCA1974) is £1. Thats a standard fee. The guy you spoke to could be such an idiot that he doesn't even know that but WF as an organisation certainly are aware of that. Alternatively he might full well know that but just be talking ####.
    Thats why I wouldn't bother with phone calls to them.

    A £10 fee is the amount an organisation is allowed to charge under the DPA for a full copy of everything they hold on file about you. Again even WF know that.

    A statement of account should be provided at no cost for a debt in dispute.

    To be honest its up to you, if you only want the agreement then I would just send the £1 fee and one of those template letters (ignoring what he has said), if you decide you want all the info then send a SAR template and a £10 fee. What I wouldn't do is send a CCA request and then put in a £10 fee.

    I did call him back just now! Ive reitterated all you have told me, £10 fee is for a full access of my information they hold on file, all I want is a copy of my agreement which the £1 fee is applicable by law.
    He said he would need to check with someone, I said Welcome Finance should be aware of this anyway even if he wasnt. He will call me back later aparently. Will see what they say!

    I know they are being awkward because I am so sure they will be owing me a PPI claim. I have seen on here that they had been put into default so I am to send a claim to the FSCS. If this all goes to plan I should hopefully be able to end all ties with WF, they are useless!!

    (Hope im right) lol
