Resigning whilst on Maternity Leave

    Hi,

    I have to agree with Savvy Sue, the employer's default position is that you are taking 52 weeks leave, 9 paid at SMP and 3 unpaid AML, unless you have agreed otherwise before your leave starts.

    So the onus is the on the employee to to notify the employer if there is going to be any change to this, however we usually write to our employee a couple of months before thier leave is due to finish to asceertain if they are taking any annual leave, paternity leave after thier leave finishes, there is the option of ' I will let you know' but we ask that they confrim their intentions at least 28 days before the maternity end date. 28 days (4 weeks) is usually most peoples notice period anyway.

    But I think the statutory minimum is 8 weeks, so it sounds as if you are being generous there!

    Youre correct Savvy_sue it is 8 weeks if they wish to return early (although the employer can agree something earlier if they wish), otherwise the employee can return on the day after 52 weeks of leave.

    I have resigned folks, gave them 2 months notice and they have been fantastic, too good in fact boo hoo going to miss them.

    I was so organised at work but now officially a SATM I am struggling :o( Love spending time with my little guy with the guilt I feel at my hubby having to support us both arghh, also thought I would have time to make all these home cooked meals and the house would be spotless well big hahaha.

    If you're happy then thats the main thing, I guess you'll find your natural routine as it comes :)
