    If you have not paid anythign towards the debt in 6 years, or acknowledged it in writing, then once the 6 years is up, you can defend any attempt at legal proceedings. You could send a prove it letter but I would suggest nothing.

    And why or why are you paying someone loads of fees to do a DMP when you could get it free with a debt charity or DIY; pay more off your debts and get debt free sooner? particulalry since ythey do not even seem to understand basic rules regarding coping with creditors.

    Thats another thing I wanted to bring up actually, my DMP. I was with Baines and Ernst at first but what a rip off! Dont get me started on them. Was with them for 2 years and my debt doesnt seem to have shrunk much from what it was originally. Read some really, really bad reviews about them recently too.... Anyway, I wasnt happy at all with their services put it that way. So my friend recommended Chiltern. Im in my 3rd month with them and they seem to be ok at the moment but thats what I thought about Baines and Ernst at first....
    My debts total approx 5 and a half k and due to my partner being ill, can no longer work and im his carer, were on benefits and our disposable income is only £85 per month- Chiltern take 30 or 35 a month fees which is less than Baines and Ernst but im still only paying 50 or 55 to my creditors (ive got approx 10 creditors in total) so really they are getting a pittance every month and it will take approx 7 years? to pay off our debts!
    My partner mentioned DIY but when we tried it in the past, each creditor was demanding large monthly amounts, totalling in excess of 400 a month. So thats why I entered a DMP. How do i get each creditor to accept what I can afford to give them each month, rather than how much they WANT or demand me to pay?
    And what debt charities could help and not charge fees each month?
    Ive even considered bankruptcy, i mean we dont own our own house so got no estate. A relative offered to GIVE us the money to go ahead with bankruptcy and the offers still there....
    Would just LOVE to wipe the slate clean and start over especailly with having 3 kids to think about. And not being able to obtain credit due to bankruptcy doesnt bother me either. They can stick their credit where the sun dont shine!
