Debt collection agencies/ fredrickson international

Has anybody had any dealings with these people? How much power do they have?

    Nope and none what so ever.

    You need to tell us what the debt is for and as much info as possible on the debt then we can help you.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.

  • Ok,

    It is for capital one- but they have demanded the payment in full which I know they cannot do- they have been writing to my parents address but have recently written to me at another address- asking me to 'confirm this is my new residence' the CAB have been helping me with debt problems and have written to all creditors offering repayment.

    I am also very annoyed with Captial One as twice they have refused to deal with the CAB saying that they have the 'wrong' signature- or they don't have one hence now its has been passed on to Fredricksons which I feel is just hampering any progress!

    I am not sure how to deal with it from here! I am happy to start making payments, but to Capital One.

    It is usual for a DCA to ask for payment in full initially. And in certain circumstances (such as if they are sending you a notice of default) it would be correct to ask for the full payment.

    If they have bought the debt from capital one then you will have no choice but to make payments to them. It may be that they are acting on behalf of capital one though so you need to establish that first.

    What have they actually sent you in this letter you have received? do they refer to CapOne as their client? have they provided a notice of assignment?

    All you need to do is resend the payment offer letter to fredrickson.

    What rights do they have? well if they have bought the debt from cap one then exactly the same rights they had - ie to report to the credit reference agencies, to start court proceedings etc.

    Actually a lot of people find once their debt has gone to a debt collector they can be easier to deal with, to agree to your repayments and to agree to freeze interest etc.

  • Thank you. I am not sure if they have brought the debt or not. I was not happy to deal with them as I have read some awful things about them and I know Debt Collection Agents are bullies. I obviously cannot pay this in full- if I could I would not be in this position. Also I have been told before that the agencies are just here to scare and actually do not have any power.

    I know they have been calling my parents house and I have written to them to tell them to stop and to deal with the CAB- but I am now concerned about the letter I have received at another address- saying they have made enquiries and believe this is my residence and call a number to confirm. I don't know how they found this address.

    Its very easy for DCAs to find a new address (assuming it is your new address). Usually your credit file gets updated with your new address (ie if you move an account from the old address to a new one, or if you apply for a credit product and tell them your previous addresses, or if you apply for your credit file and add in your old addresses).
    There are other ways as well such as the edited electoral roll, phone databases and things like 192 online etc.

    They will probably know you cannot pay it in full but they will always request it (as occasionally people will be frightend into borrowing the money from family etc to repay the debt).

    If they have bought the debt then they do have powers and could decide to take you to court - what we would usually say to people is that DCAs don't have any powers if they visit your property to ask for payment (unlike a bailiff for example).
    However as long as you pay them a monthly payment you can afford then its likely they will accept this and may well take no further action (other than to try to get you to increase your repayment periodically).

    I actually do not want them to write to me at this address- apart from the fact I will not be living there for much longer.

    If that is the case I would like them to deal with the CAB who have been writing to all creditors/ Alos I have written a letter saying I would prefer to deal with Capital One and I do not want them harrasing my parents with phonecalls.

    So you are saying it is actually better to deal with them instead of CAP 1 ?
