Hi,
I recieved a letter from BCW stating that they will be arresting my bank account for council tax arrears and have said my local council has agreed to this. I am a bit concerned about this and wondering if they can actually do this???

Hi Lorrygirl,
Have you contacted your local council to discuss the arrears?
My OH got a letter from BC&W several months ago regarding council tax arrears from over 10 years ago, which he had no recollection of and was puzzled to why they'd never been in touch before now as they would have known where to find him easily. He contacted the council who explained the amounts and dates of the arrears, BC&W also had this info.
In the end he just paid the debt off in full as we're in Scotland and as council tax is a priority bill, he was also terrified incase they sent bailiffs around in the end. In the 2nd letter they sent, threatened to arrest his bank account too, which he doesn't use anyway, as all money goes in my account, so is practically empty. BC&W will keep threatening you, contact your local CAB office who will give you advice on how to go about things. Don't know where abouts you are, but council tax laws are different depending where you are.

Did you check that the bills from the council and BCW were the same amount?
When was the LO gained? In Scotland arrears of council tax and community charge can be recovered for up to 20 years from the date of the Summary Warrant which is similar to a sheriff court decree.
Summary Warrants for council tax arrears are automatically granted by the sheriff court following an application by the council.
The Council Tax (Administration and Enforcement) Regulations, 1992 do not apply in Scotland.
Seems alot of councils are going back along way with CT atm, as their budgets are being cut.I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.
PRESS THANKS

I don't know when the council applied for the liability order, as my OH dealt with most of it, but know he went through it all throughly and spoke to CAB too - who said best to pay it. Council said they had sent numerous letters to his parents address, and as his dad has the same name as him I can imagine they got ignored, since I know they had council tax arrears too.
The amounts and dates given by the council matched the amounts BC&W had exactly down to the last penny. We knew about the 20 year limit under Scottish law and the amount of arrears due wasn't huge, so he just paid up in the end to get rid, as I was pregnant at the time and got so stressed out about it.2017 - no clutter to be seen challenge: 72/2017
