another question though is if i cant get credit solutions to accept my repayment plan would i send account in dispute due to lack of CCA then

I would certainly wait to see what CS do/say when they contact you.

The problem is, without being able to see the documents that you've been sent, it's next to impossible to work out whether Cap One truly lack an enforceable CCA. The fact that they felt the need to send you a reconstituted one suggests that they haven't got one, but no more than that. Sometimes it's prtetty hard to work out even if you can see the documents, let alone without.

However, if neither Cap one or CS accept your payments plan, then you may well be forced into a stance of "accept the payment or take it to court if you think you can"?

Hopefully it won't come to that though...
