Capquest Debt from a long time back, looking to clear it. Please help!

  • I've not had any contact at all, just the letter saying they'd look for my credit agreement and statment which was a couple of months ago now.

    I set up a DD back in 2007 but cancelled it before I made a payment. Not paid anything on if for a good 6 or 7 years something like that. I'm really perplexed as to what could possibly be happening and what to do next.

  • I have money saved up to pay this debt but they've never contacted me again and according to my credit report, the debt doesn't exist.

    Does this mean it's gone or just lurking in the shadows?

    May be gone, or they may have sold it on to another debt collector?

    Wouldn't this mean the debt is statute barred?

    You set up a DD but didn't actually make a payment. As long as you didn't make a payment, acknowledge the debt in writing or have a CCJ issued in a 6 year period then it looks statute barred to me and they won't be allowed to take you to court.

    Thats what I was I was thinking, even if it was acknowledged it at the time of setting up the DD, I will become statue barred next year. I wouldn't contact them at all!

    I had already sent them the letter requesting a credit agreement.. it seems they couldn't get it and have sold the debt onto another company called "Past Due Credit Solutions" as they are now contacting me on behalf of Capquest.

    Does the fact that I send the letter requesting a credit agreement (to capquest) stop it from being statue barred?

    Should I send the same letter to the new company or should I try and send them the Statute barred letter?

    I'd really appreciate some more advice. Thanks in advance!

  • Find out when you last made a payment, or acknowledged the debt in writing then add six years on to it.
    That is when it's statute barred.
