Please can you help with Full & Final to Hamptons Legal??

Hello would love some advice on making a Full and Final offer for a catalouge debt to Hamptons Legal (Lowell). I Owe them £628.47 and have £200 which I can offer as a F & F. I have a link to National debtlines letter. Do you think it is OK to send the letter offering the £200??
I had to phone somebody there today to find out what address to send it to and said why i needed the address and he has said they are unable to offer any discount on the debt - Is he just saying this on the hope ill cave there and then and set up a payment plan??
I have never made a payment to the account :o.

Any advice would be great and if I do send them off a offer and they reply what do i look for?
Should i offer a lower amount first incase they up it a little?? I might be able to up it a little if it means the account would be settled......

  • I would still send the letter and see what happens. Like you said, he was probably hoping you would simply setup a payment plan so they can get more money out of you.

    It can do no harm to send your letter. If I were you I'd send your letter to whoever you owe the money to not their debt collectors though. They will be paying the debt collectors some kind of fee so at the right level it may even be worth them taking your offer (though £200 in comparison to the debt seems a little low to me).

    I would also suggest enclosing a statement of your affairs as they are only likely to accept if you can show you are in genuine difficulties.

    Just ask Lowels for a true and signed copy of your credit agreement. Under the CCA Act 1974.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    If it's pre-April 2007, that's definitely the way to go - the debt would be unenforceable if there's no signed agreement.

    If you haven't made a payment or otherwise acknowledged the debt for a six-year period it's unenforceable .

    In those two instances, they would be lucky to get £10 from you, never mind £200.

    I've offered a lot less with my debts in the past, and in my experience they've usually met halfway. So expect them to say £400 and they'll close the account. Make sure you get their offer in writing and that it is and will be a full and final and your account will be closed.
    Anyway, it's worth having a go, after all, the worst that they will say is no!

    Don't forget to put in the letter that the money has been offered to you by a relative in order to pay this debt (if it's not SB and they have a signed CCA of course ;))

    Otherwise, you'll get some wise guy from Hamptons demanding that you pay off the whole debt as you obviously have spare cash lying about! :mad:

    Thanks for all the replies. Its not from before 2007....
    When i Phoned to say ask address I said it was a gifted amount and I will make sure i put it in the letter aswell (It is a gifted amount anyway so im not making it up:))
    I will send the letter and see what they say - if not they will get the amount that I can afford each mth rather then what they are demanding at the moe..... But they have said its on hold for 30 days so hopefully they will stop harrasing me for a little bit???

    In that case I would offer them £100 at best assuming that they can prove the debt exists by produciing a copy of the Consumer Credit Agreement
