When to start Maternity Pay

i know you can claim mat pay from the day you start your mat leave, but can you defer it?

quick outline: - while on mat leave you still get your holiday entitlement. but my employer dont let you carry over holiday from one year to the next. as my baby is due april, and im planning on taking the full 9m leave, i wont be due back until feb of the following year, so wont have used my holiday leave. i dont want to leave work earlier than 4wks before my due date, as id rather have more time off once baby is here.

so, if i wanted to leave 4wks before due date, and for those 4wks i used my holiday, what would happen if the baby arrrived early. say if it was 2wks early, would i be made to switch over to mat pay, as of the day the baby arrives, therefore losing 2wks holiday? or can i say, i want the first 4 wks of my leave to be treated as holiday pay, then the next 6wks on 90% pay, and then start SMP

or will it be easier to plead exceptional circumstances with my employer, so they agree i can carry my holiday over to the following year. whatever happens, im still taking the same amount of time off, its just the order in which they pay me, that will be affected

    I had a similar situation where I had hols owing & due to take maternity leave. In my case my employer simply tagged them on to the end of my mat leave despite not allowing as a rule to carry hols from one year to the next.
    Not 100% sure but think that you have to start Mat leave from day baby arrives. Either way, the company cant take the holidays off you so I suggest that you just ask them how they would like you to sort it out - put the ball in their court so to speak & see what they come up with. Let them worry about it - you have enough to contend with!!

    if you cant take the leave due to being on maternity leave, and your employer wont carry over they have to pay you for it.

    I've got the same problem my baby is due on the 29th of April 2007 and my annual leave resets on the 1st May 2007.

    I am going to ask my employer if I can carry 3 weeks forward so I can leave on the 8th of april and add 1 week to the end of my maternity leave or get paid for it.
  • When I was pregnant with my little boy I took all of my holiday (holiday year was Jan - Dec) before starting my maternity leave (they were not keen about this but HR told my boss that it was OK). I finished in January, took four weeks leave then started my maternity leave February with an intended return the following January. Fully intended to return :rotfl: but asked to go back part time and they offered redundancy so I took it.
