Payday loan issue - please advise!

Hi,

I'm new to this, so apologies if this is in the wrong place.

I am in the process of beginning a DMP so am waiting to hear from creditors. I have been signed off sick, so am currently on benefits and my income has reduced drastically. One of my creditors is wonga and i missed the payment last week. This isn't a problem in itself, as i'm sure sooner or later they will agree to a payment plan. The issue is that two years ago, i had a loan with them and my mum lent me her card to make a one-off payment.Obviously i had to enter her card details to do this. My mum checked her statement last week and has found wonga have taken out 3 payments - 2 x £10 and 1 x £360. After an email to them, it turns out they have taken this from her account to pay for my loan as i didnt have the funds available. We had no warning or any contact from them and now my mum is overdrawn and has £200 of bank charges on top of that! We have spoken to her bank to say that they didnt have permission for this and they say that as she gave permission to them at some point in the past, they have done nothing wrong in taking this money. I was unaware that her details were still on file and wonga will not allow me to remove them until i have paid all i owe.As i say, i am sorting a payment plan but they are being difficult! I got advice from citizens advice and they say they are unsure as it could be fraud as they had no permission in this instance, but also that as she gave previous permission, they can do this. I dont know what to do as i have have been given conflicting information. Can they take random amounts whenever they like, even if they dont have permission at that exact moment in time? I realise that it says on their site that by giving any payment details at any time, they can use them at any time. But as it isnt in the wonga account holders name, shouldnt they have got permission?

Sorry to waffle on, i know it is long and appreciate any help/advice offered.

I was desperate at the time i took this loan out and will NEVER take out a payday loan again! You never know when your financial circumstances might change for the worse!

    As soon as you gave them your mother's card details you agreed to allow them to take payments from it in order to clear the existing (2 year old) or current account(s)

    Their Ts & Cs state that they will try and take payment from any cards that they have on file.

    Wonga are not interested in DMPs. They want the money back that they lent you, as per the original agreement.

    If the debt to Wonga has now een paid in full, your debt is now to your mother.

    I am sure she will agree some kind of plan with you.
