Separating- Mortgage help please

Hi

Please can I get some help.

I have recently separated from my husband of less than a year. We have a mortgage and we will be in negative equity for sure. He is currently living in the house and I have moved back to my parents. I am currently paying half the mortage but would do want to continue to do so as I am not living there and I dont want to take the house on - I want rid for a fresh start.

My husband does not have a regular income and therefore him taking over the mortgage is not an option. He is going to drag his feet and try to stay in the house for as long as possible and he wont allow me to remove any of the contents of the property either.

Can I force him to sell the house?

Can you sell when its worth less than we owe? and share the debt that remains?

I dont want to stop paying the mortage and ruin of credit rating but I also dont want to pay to keep a roof over his head in the long term.

Also where do I stand if he moves someone else in?

Please advise. Any help much appreciated.

    Consult a solicitor for advice

    Speak to your lender.

    Yes, you can force him to sell the house. However this is an expensive exercise. If your husband has no assets then you won't be able to recover the costs of doing so.

    A solicitors letter may well make him think a little.

    And point out to him that as you're not living there and he is, he should be paying you rent. He'll probably tell you to go and jump, but it might make him think a little harder about dragging his feet - especially if it's mentioned in a letter from a solicitor.
