Thought I was free of debt!

    I believe they can still ask, but they aren't allowed/supposed to pursue aggressively (hah! :rotfl:), and it is wholly down to the discretion of the debtor as to whether or not they wish to pay. And even if the debtor does decide to make payments, the debt still remains forever Statue Barred, and they could cease payments at any time they chose with no repercussions.

    If a debtor isn't feeling charitable (and, let's face it, as far as DCAs are concerned, who would be? ;) ), there is a 'Sod off, it's Statue Barred' template letter which can be sent to shut them up. :D

  • Evreyone, thankyou for the speedy replies - the advice is really appreciated. I've tried my online banking but will have to write off for my statements from so long ago. I will be taking the advice about the 'prove it' letter.

    Will the debt still be statute barred even though they have contacted me within the six years - I have never acknowledged the debt is mine?

    Also, I am now incensed!!!!!!!!!!!!!!!! Since posting this morning I went to bed ( working night shifts ) and awoke to find two missed calls from Fredricksons on my mobile but then got a phone call from my mum who says they have left a message on her answerphone saying I needed to contact them.
    I have not lived at my mums address for nearly ten years, Fredricksons know I don't live there and they obvioulsy already know my mobile number - I have no idea where they have got my mums number from!!!!

    Is there anyway I can stop them phoning my mums?

    Yes, the debt will still be/go SB. Although if the last payment was recorded as May 2005 it's not quite SB yet.
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared
    [STRIKE]23.16%[/STRIKE] 22.49% of my debt. :(

  • One further question to mither you with......

    I have checked my credit file and there is no default from the original Orange account - can Fredrickson now default me on this matter????
