t mobile contract being chased by lowell

hi,
wondering if anyone has advice about my partners debt.
background.......she, rather foolishly i think, got a contract phone for her unreliable sister who suprise suprise ran up a huge bill and then stopped paying it.
sister then told my missus she was paying small amount to collections dept and was working towards clearing debt..mmmh ok.
then last week my partner gets letter through from lowell wanting best part of three hundred quid.
I went ding dong and spoke to lowell and the bloke ,although not particularly rude, was just trying to baffle with bulldust.
I said that me an my partner want a copy of original agreement for ourselves just to double check and verify for ourselves he said we could not have one as it does not exist..... is this right?... even though my partner remembers the guy in the shop getting her to sign it and telling her it was a credit agreement under the cca. She is not trying to get out of paying but just want to check as we have seen watchdog and all the horror stories about lowell finance and how they operate .
I have to be honest that these prunes do not worry me but my partner is now petrified that lowell are gonna send heavies round to collect this money.
Thats what she gets for trying to help her less fortunate sister.....wrong aint it....

    It won't be a consumer credit agreement that was signed - it will be a service agreement which is not covered by the consumer credit act.

    You could do a subject access request to get copies of the agreement and everything else they hold on file (costs £10) but not a CCA request. Alternatively write and ask them for a full breakdown of the account so she can see what charges etc have been put on and check these to her agreement etc.

    Alternatively if you are in a position to do so wife might want to try offering a reduced full & final settlement in writing. She could even try to offer one in exchange for getting the default removed from her credit file (which will almost certainly be on there).

    I'd have thought the person to go 'ding-dong' with is the wife's sister, rather than the debt collector who is only trying to collect money that is rightfully theirs.
