What can i do

Can i do anything?

About 1 year ago i had a letter from a debt collection company saying i owed HSBC £386. it did not ring any bells so i requested a copy of the cca.

On doing this i had a letter saying they could not supply this and the account was put on long term hold.
i then wrote to HSBC again asking for the cca and never heard a thing.

for the past week i have been getting phone calls about 8-10 times a day from CAP QUEST saying i need to clear the balance at first i started off being nice telling them i did not acknogledge the debt and the cca was needed if they wanted me to take them serious. but now with the amount off calls i am getting i told them any further corrispondence should be in writing. But this has still not happened i am just getting call after call from them.

Is there anything i can do as they did not send a copy of the cca within the 28days.
They have also ignored my request to send me letters rather then call me.
all help very welcome please.

thanks

yes, you should report them ( i think) to the FSA for harassment

Im not 100% though, but im sure Ive read that on here a few times.
 Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
Theres no dollar sign on piece of mind
    This Ive come to know...
So if you agree have a drink with me, raise your glasses for a toast
  • Don't you have any idea what it could be? Have you had any dealings with the HSBC group of companies re: loans. credit cards, HP agreements etc?
  • I am unsure if I am allowed to post a link on here but the best post I have ever seen about harassment is this one:

  • Borrowed from another forum is a letter that you could also send to get proof of debt:

"I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.

Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities."
