Been frauded need advice.

Ok me and my boyfriend are looking to move in together. Yet im wondering what do they actually check when they view your credit file? I have read its just the public record and not in detail so just make sure you haven't got any CCJS or have been bankrupt. I have 2 defaults on my credit file which have understandably dragged my score in to the poor category at 349. One was for a credit card with RBS and i was made unemployed and was unable to make any payments for a few months. This was paid off 3 months after i defaulted in one payment and is now showing as default satisfied. The other is co-op bank loan which i have disputed as not me so therefore fraud. They sent me a letter from a local debt agency last year and i wrote back asking for the signature of this supposed debt i heard nothing back until this Jan of another debt recovery agency. I again wrote back asking for the signature and wrote back last month asking if this had been done which they said they had requsted it twice of the Co-op Bank. Im guessing this is going to affect me moving out so im looking for advice on what i should do? I cannot complain to the financial ombudsman as i need the signature off the account. Anyone got any advice? Im worried that there going to issue a CCJ. This debt company also wrote to me saying if i paid half of it it would be cleared.

    What do who check? If a lettings agent asks for your permission to search your credit file and you give it then they can see everything on your file (defaults etc) - (its usually a 3rd party that does it on the agencies behalf in reality).
    If they don't ask your permission or you don't give it then all they can see if the public information which as you say is just any record of insolvency and any CCJs, fines etc.

    Have you sent the prove it letter for this debt for them to provide proof its your debt? what did they send back?
    Have you sent a formal CCA request and enclosed a £1 postal order to get a copy of the credit agreement?
    Have you formally (in writing) disputed that the debt is yours?

    No if you give your permission for a credit search (and they will almost certainly make it a condition) then they will see your defaults.

    A DCA can't "issue a CCJ", a court does that. They can apply for a CCJ but you have a right to be heard too and if you turn up and say to the court the DCA refuse to prove the debt, taking with you copies of every letter in or out, then they aren't going to win. They know this, which is why they wont take you to court if you make clear that you know this. Oh they'll threaten too, it's all a big game of bluff. You have to keep all communication in writing, DCA's really are the biggest liars going. "Issue a CCJ"- sounds exactly like something a phone-a-prat DCA call handler would say.
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared
    [STRIKE]23.16%[/STRIKE] 22.49% of my debt. :(

    They haven't sent anything back except they have asked Co-op twice for the signature on the account? What is a CCA and how do i go about doing this? I disputed the debt in writing to the first debt agency and with the 2nd company through email.

    Thanks for the infomation. I meant im worried that the Co-op Bank are going to turn round and issue me a CCJ when this debt is not mine.

    Do you think it might improve my chances if i put a notice of correction on my credit report?
