Getting a default removed

I found some old forums that gave advice on getting a default removed.
My other half had a default placed on his credit card account when he failed to make 3 payments a couple of years ago. He did fully settle the account but the default stood. As a result we are having trouble getting a joint mortgage due to this one action.
We therefore wrote to the credit card company concerned and asked for a copy of the default notice as he doesnt recall receiving it. However they have replied advising that as the account is now closed, there is no active agreement between him and them and therefore they are under no obligation to provide the documentation requested.
Despite the account being closed is there something under the Data Protection Act or Consumer Credit Act that means they must supply the info?
Failing that is there any other way that we can try and get this removed. It was only for a little over £300 but is having a huge impact on our credit.
Any help or advice gratefully received.

You could send the CC Co an SAR (Subject Access Report) request, although it does cost £10. They have 40 days to reply with all info they hold on you, regardless of the fact the account has been closed, I understand they have to comply with the SAR.

Unless there was an actual error the chances of getting a default removed are slim to non existant.
If anyone was able to get them removed, how would lenders be able to judge good and bad risks?"We want the finest wines available to humanity, we want them here, and we want them now!"0 -
I have a default on my credit file i never recieved a default notice, can i do anything about this? The debt is now paid off.0

If a defaulted account is paid off, does it not show on your credit file as "settled" instead of defaulted?0

It does show as settled, but the default still exists!!
And I can understand the need for judging bad and good risks with individuals, it just seems harsh when it was for a little over £300 and was paid off within 3 months and was only the one occasion, all other credit being perfect! Will wait to see the outcome having now sent off the SAR!! We can live in hope King Elvis!0 -
Unless there has been a major error, defaults stay on your credit file for 6 years, whether settled or not.make the most of it, we are only here for the weekend.
