Nearly There!!

Hello everyone,

Just a bit of help needed, I first sent my Orignal letter to The Halifax on the 2nd October for my staments for the last 6 years, I then recieved a reply on the 7th Oct first offer of £700.00. I sent off politly refusing on the 11th oct, and recieved a reply on the 18th saying no we are not going to give you anymore money, blah blah. I then sent the LBA on the 19th and had a reply on the 24th oct stating exactly the same thing as before. I am now at the stage of filing my MCOL but have to wait for the pennies to be paid (on the 28th from work) before I can file.

Will this effect the claim as the 14 days that they had to reply was up on the 8th november, but I cant file untill the 28th?

Can anyone enlighten me?

  • LOL - I'm in EXACTLY the same position with my old bank!

I'm going to send the polite refusal letter, but with something like "as a goodwill gesture I will wait till the 30th November before submitting my court claim to allow for full and final settlement".

I've asked for advice on the CAG board, and will have a look at the charges refund board here at some point today too...

  • I can't remember where I got my letter template from but I altered the phrase "immediately begin court action" to "begin court action without further notice" if they didn't respond satisfactorily in the timeframe I'd given. That basically cleared me to start MCOL at the best time for me (after payday) without having to extend deadlines etc.
